A 21-year-old man arrested for having sex with a 14-year-old girl told police that he thought she was 19, court documents say.

Brandon Ensley appeared in Natrona County Circuit Court Monday where he heard second- and third-degree sexual abuse of a minor charges against him.

Second-degree sexual abuse of a minor carries a maximum sentence of 20 years behind bars while third-degree sexual abuse of a minor is punishable by up to 15 years in prison.

According to an affidavit of probable cause, Casper police were called to a home after the owner found a man in his 14-year-old daughter's bedroom.

When officers arrived, they saw the girl arguing with her father, who said he wanted her to be taken to the Youth Crisis Center. As officers placed the girl in handcuffs, Ensley returned, according to the affidavit.

The girl's father told officers that he'd just arrived home and he heard a man's voice coming from his daughter's room. The affidavit says when he opened the door, he saw his daughter and Ensley having sex.

When the girl's father asked Ensley for his name, Ensley didn't answer and instead walked to the front door and took off running, the affidavit says.

According to the affidavit, Ensley, who said he lives in Cheyenne on Monday, told a police detective that he and the girl began messaging over Facebook.

Ensley allegedly said his conversations with the girl were "nothing really sexual" and the most sexual thing about them was cuddling and watching scary movies.

He also told detectives that he couldn't tell that the victim was underage, the affidavit says.

"Ensley then explained an officer had asked him why he couldn't tell (the girl) was that young just by looking at her," a detective writes in the affidavit. "Ensley stated anyone who had ever been to Virginia Beach would understand 'why I did it.' Ensley said it was normal there to be '22 and look like that.'"

Court records show Ensley gave police Virginia driver's license.

At roughly 10:30 the night of the alleged incident, Ensley was dropped off outside the girl's house. The affidavit says he described hopping over a fence and being let in through the back door.

Asked how old he thought the girl was, Ensley said she "looked about 19." He also told officers that he believed the girl told him she was 18 over Facebook messenger, the affidavit says.
