A Casper man is accused of using a hammer to attack a person that he was in a fight with.

Forty-five year old John Kosmata has been charged with one count of aggravated assault.

Investigators with the Casper Police Department say on Sunday evening, November 30th, officers were called to a residence on 10th Street for a report of a fight.

When they arrived, they found Kosmata and the victim covered in blood, and one witness said that Kosmata had hit the victim a number of times with a wooden hammer.

Upon interviewing other witnesses, it was determined that the victim was trying to enter the residence, but Kosmata wouldn't let him enter, and then started punching the victim.

Kosmata claimed he was attacked first, by way of being choked

Another witness told police Kosmata then became angry, when the victim said a disrespectful comment to another person, so then he got the hammer and attacked, but Kosmata claims he did not use a weapon.

Officers did not find any evidence of drug or alcohol use, but a nurse at the Natrona County Detention Center, said a breathalyzer revealed that Kosmata had a .048 blood alcohol content.

He is being held on $50,000 bond awaiting trial and could face up to 10 years in prison if convicted.

Prosecutors told a Circuit Court Judge that Kosmata has a previous conviction in 1993, of assault with a deadly weapon.
