It's uncertain if a man will survive after he was hit by a drunk driver in Natrona County, a prosecutor said.

Ethan Perez, 29, was arrested at 12:20 a.m. Monday on charges of DUI with serious bodily injury. He made his initial court appearance Monday afternoon where his bond was set at $7,500 cash or surety.

DUI with serious bodily injury is a felony punishable by up to 10 years behind bars, $5,000 in fines or both.

The incident occurred on the Highway 20-26 frontage road between 6 Mile Road and the Ghost Town Truck Stop.

According to an affidavit of probable cause, Perez called dispatchers at 11:27 p.m. Sunday and advised that he "smoked" a pedestrian.

When law enforcement arrived, they found a man lying in the middle of the road with "an obvious" leg fracture, the affidavit states.

According to the affidavit, law enforcement could smell alcohol coming from Perez, who allegedly said he had been drinking at a bar. Perez and his female passenger left the bar because he was "buzzed." Perez said he drove because he was the most sober of the two, the affidavit says.

As he was driving down the frontage road, the affidavit alleges, Perez saw a man in the roadway as if he was attempting to cross from the south side of the road to the north side. Perez told authorities that he tried to swerve and miss the man.

Perez offered to "cut the bulls--" and go directly to jail, according to the affidavit, but also agreed to undergo field sobriety tests which showed he was impaired.

According to the affidavit, the man Perez hit suffered a broken leg, multiple broken ribs and several skull fractures along with having a "very poor" recovery prognosis.

Natrona County Assistant District Attorney Trevor Schenk said it's uncertain if the man Perez allegedly struck will survive.
