Opponents of the bill say it is potentially unconstitutional as it could give national chains that are not publicly traded an unfair advantage.

Town Manager Dan Sabolsky says if voters approve the tax hike in November, it would raise an estimated $1.2 million annually.

In addition, the proposal would have subjected electronic cigarettes to state taxes.

A third proposal that would have imposed a five-year escalating tax also died.

The sticker would cost $100 a year.

Wyoming already levies a $1 per megawatt hour tax on wind production.
