CERCY'S ATTORNEYS WROTE THE NEW TRIAL HINGES ON WHETHER HE PERFORMED ORAL SEX ON THE ALLEGED VICTIM, WHICH WAS THE ARGUMENT THE PROSECUTION MADE IN TRYING TO PERSUADE THE JURY TO CONVICT HIM ON THE OTHER COUNTS.

NATRONA COUNTY DISTRICT ATTORNEY MIKE BLONIGEN HAS ARGUED THAT HE CAN PROVE CERCY PERFORMED ORAL SEX ON THE ALLEGED VICTIM.

BUT CERCY'S ATTORNEYS SAY BECAUSE THE JURY REJECTED THAT ARGUMENT IN ITS VERDICTS ON THE OTHER COUNTS, SO THE PROSECUTION CANNOT USE THAT ARGUMENT FOR THE THIRD COUNT.

IF THE COURT DOES NOT DISMISS THE CASE, THE ATTORNEYS ARE ASKING THE COURT EXCLUDE ANY REFERENCE TO ORAL SEX DURING THE TRIAL.

INVESTIGATORS DETERMINED SORBER WAS A PERSON OF INTEREST WHO WORKED AT THE NEARBY CAFE.

THEY BEGAN WATCHING HIM, SURREPTITIOUSLY OBTAINED DNA FROM A BEER CAN HE HAD, AND FOUND THE DNA WAS CONSISTENT ITEMS FOUND AT THE OFFICE.

ATF AGENTS INTERVIEWED THE OWNERS OF THE BUILDING, AND DETERMINED IT WAS USED IN INTERSTATE COMMERCE, LEADING TO THE FEDERAL CHARGE.

ACCORDING TO AN AFFIDAVIT OF PROBABLE CAUSE, SPRINGER WAS DRIVING SOUTHBOUND ON CENTER STREET SHORTLY AFTER 1:30 P.M. MONDAY WHEN SHE REAR-ENDED ANOTHER VEHICLE THAT HAD BEEN STOPPED AT A RED LIGHT AT THE B STREET INTERSECTION. SPRINGER TOLD POLICE THAT HER FOOT HAD SLIPPED OFF THE BRAKE.

AN OFFICER REPORTEDLY SMELLED A STRONG ODOR OF MARIJUANA COMING FROM SPRINGER AND HER VEHICLE AS SOON AS HE ARRIVED AT THE SCENE.

AN OFFICER WHO HAD BEEN CERTIFIED AS A DRUG RECOGNITION EXPERT ARRIVED AT THE SCENE AND DETERMINED THAT SPRINGER WAS UNDER THE INFLUENCE OF A CONTROLLED SUBSTANCE OTHER THAN ALCOHOL. SPRINGER WAS ARRESTED.

A SEARCH OF HER PERSON TURNED UP A SOCKET CONTAINING SUSPECTED BURNT MARIJUANA. INSIDE SPRINGER'S VEHICLE, OFFICERS FOUND A GLASS PIPE WITH BURNT METHAMPHETAMINE INSIDE.

AFTER BEING TAKEN TO JAIL, SPRINGER ADMITTED THAT SHE HAD SMOKED MARIJUANA ROUGHLY TWO TO THREE HOURS BEFORE THE CRASH.
