K2 Radio News: Flash Briefing For August 17th, 2018 – Morning
NATRONA COUNTY DISTRICT COURT JUDGE THOMAS SULLINS WILL REVIEW TESTIMONY GIVEN THURSDAY AND LAST MONTH TO DETERMINE WHETHER A CONVICTED CHILD MOLESTER SHOULD RECEIVE A NEW TRIAL.
IN JULY 2016, JOSHUA WINTERS PICKED UP A THEN 5-YEAR-OLD BOY AT A BOWLING ALLEY ON CY AVENUE, TOOK HIM TO THE RIVER AND SEXUALLY ASSAULTED HIM.
A JURY CONVICTED WINTERS IN MAY 2017 OF FIRST-, SECOND- AND THIRD-DEGREE SEXUAL ABUSE OF A MINOR, AND SULLINS LATER SENTENCED HIM TO 80-115 YEARS IMPRISONMENT.
IN MARCH, HE ASKED FOR A NEW TRIAL THROUGH HIS ATTORNEY KEITH NACHBAR, CLAIMING HIS PUBLIC DEFENDER ROB OLDHAM FAILED TO ADEQUATELY DEFEND HIM.
THURSDAY'S TWO-HOUR HEARING WITH A DNA EXPERT FROM THE WYOMING CRIME LAB CONCLUDED A HEARING LAST MONTH.
IN HIS CLOSING ARGUMENT, NACHBAR SAID WINTERS DESERVES A NEW TRIAL BECAUSE THE ALLEGED VICTIM WAS THE ONLY EYEWITNESS, OLDHAM DID NOT INVESTIGATE OTHER WITNESSES AS MUCH AS HE COULD HAVE, THE VICTIM GAVE INCONSISTENT STATEMENTS, AND WAS NOT COMPETENT TO TESTIFY.
ASSISTANT DISTRICT ATTORNEY KEVIN TAHERI RESPONDED THAT THE EVIDENCE AND TESTIMONY WERE OVERWHELMING.
TAHERI SAID WINTERS GAVE CONTRADICTORY STATEMENTS ABOUT WHAT HAPPENED THE NIGHT OF THE ASSAULT.
VIDEO SURVEILLANCE SHOWED WINTERS' AT THE BOWLING ALLEY, THE VICTIM WAS CREDIBLE AND HAD NO REASON TO FABRICATE THE STORY, OLDHAM HAD ACCESS TO AND LISTENED TO RECORDED INTERVIEWS, AND WINTERS' DNA ON AN ANAL SWAB SHOWED A SEXUAL ASSAULT HAD HAPPENED.
TAHERI SAID OLDHAM DID A CREDIBLE JOB IN DEFENDING WINTERS, AND THAT JOSHUA WINTERS GOT CONVICTED BECAUSE HE WAS GUILTY.
