ON FRIDAY, THE FIFTH DAY OF THE TRIAL, CERCY'S LEAD DEFENSE ATTORNEY PAMELA MACKEY CALLED MARY CABLK, A SCIENTIFIC CONSULTANT, TO TESTIFY ABOUT AN EXPERIMENT SHE SET UP.

CABLK SAID SHE CRAFTED A HYPOTHESIS STATING THE DOGS WOULD HAVE BARKED LOUDLY IN THE ROOM WHERE THEY AND CERCY'S WIFE AND ANOTHER WOMAN WERE SLEEPING NEXT TO THE ROOM WHERE THE ALLEGED VICTIM WOKE UP, SHOUTED AND PUSHED CERCY AWAY.
CABLK CONDUCTED THE EXPERIMENT IN THE CERCY HOME AT ALCOVA LAKE BY PLACING A SOUND MONITOR ON A TABLE IN THE LIVING ROOM NEXT TO THE COUCH WHERE THE ASSAULT IS ALLEGED TO HAVE HAPPENED.

SHE PLACED TWO MORE MONITORS IN THE BEDROOM.

TWO ACTORS, PARTIALLY CLOTHED, SIMULATED THE ALLEGED EVENT.

THE WOMAN WAKES UP AND YELLS AT CERCY, AND IN CABLK'S WORDS, “THESE DOGS WERE GOING NUTS.”

THE JURY HEARD ONLY THE AUDIO, BUT DID NOT SEE THE VISUAL, PART OF THE VIDEO BECAUSE IN JANUARY NATRONA COUNTY DISTRICT COURT JUDGE DANIEL FORGEY REJECTED THE DEFENSE REQUEST TO ALLOW THE VIDEO INTO EVIDENCE DURING THE TRIAL.

NATRONA COUNTY DISTRICT ATTORNEY MIKE BLONIGEN ATTACKED CABLK'S TESTIMONY, REMINDING HER THAT BOTH CARYL CERCY AND HER FRIEND WERE INTOXICATED.

HE ASKED IF THE DOGS WOULD REACT DIFFERENTLY TO A STRANGER THAN TO CERCY, WHOSE VOICE THEY KNEW; WHY THE THE ACTORS WERE CLOTHED AND NOT NEARLY NAKED AS DESCRIBED BY THE ALLEGED VICTIM; AND WHY THERE WAS NOTHING ABOUT HER MAKING PHONE CALLS LIKE THE ALLEGED VICTIM SAID SHE MADE.

CABLK SAID THOSE MATTERS WERE IRRELEVANT TO WHETHER THE DOGS BARKED.

THE TRIAL RESUMES AT 9:30 A.M. TUESDAY.

A BILL SPONSORED BY REPRESENTATIVES INCLUDING HANS HUNT, OF NEWCASTLE, WOULD HAVE ALLOWED UP TO 20 YEARS IN PRISON FOR DRIVERS WHO CAUSE A DEADLY TEXTING CRASH. HUNT SAID FRIDAY A TEXTING DRIVER WHO CRASHED IN NORTHEAST WYOMING RECENTLY BADLY HURT TWO MEN WHO WERE HELPING ANOTHER MOTORIST.

OTHER LAWMAKERS QUESTIONED WHETHER THE BILL WAS NECESSARY.

THE BILL FAILED WITH TWO-THIRDS OF THE HOUSE VOTING NO. THE BILL NEEDED A TWO-THIRDS MAJORITY TO BE INTRODUCED FOR FURTHER DISCUSSION.

A CHEYENNE MOTHER AND FATHER ARE FACING CHILD ENDANGERING CHARGES AFTER ALLEGEDLY EXPOSING THEIR 9-MONTH-OLD BABY TO METHAMPHETAMINE.

20-YEAR-OLD LISA BELL AND 19-YEAR-OLD TYREESE REED WERE ARRESTED ON FEB. 9, AFTER AGENTS CONDUCTING A SEARCH WARRANT ON A MOBILE HOME WHERE ONE OR MORE OF THE TENANTS WERE BELIEVED TO BE USING AND/OR SELLING METH, FOUND THE TWO AND THEIR BABY IN A BEDROOM.

ACCORDING TO AN AFFIDAVIT, AGENTS FOUND .5 GRAMS OF METH IN REED'S DRESSER AND 13.6 GRAMS OF METH IN THE KITCHEN.

REED REPORTEDLY TOLD AGENTS THAT HE "USED METH SEVERAL TIMES A WEEK" AND THAT THE METH "BELONGED TO HIM."

BELL, WHO ALSO REPORTEDLY ADMITTED TO USING METH, SAID "ANOTHER INDIVIDUAL DISTRIBUTED METH IN THE RESIDENCE ON AT LEAST ONE OCCASION, AND THAT THE SAME INDIVIDUAL POSSESSED A PIPE USED TO INGEST METH THE NIGHT PRIOR TO THE WARRANT SERVICE."

THE BABY WAS SUBSEQUENTLY PLACED IN THE CUSTODY OF THE DEPARTMENT OF FAMILY SERVICES.

IF CONVICTED OF CHILD ENDANGERING, BELL AND REED COULD FACE UP TO FIVE YEARS IN PRISON. REED IS ALSO FACING A MISDEMEANOR POSSESSION OF METHAMPHETAMINE CHARGE.

BOTH ARE BEING HELD IN THE LARAMIE COUNTY JAIL ON $3,000 CASH BONDS. THEIR PRELIMINARY HEARINGS ARE SCHEDULED FOR FEB. 22.
