Charging papers say the investigation began before 8 a.m. on July 18, when a report of a teenage girl sleeping in a gutter led an Evansville police officer to find a juvenile female asleep on the street.
Under the statutes cited in charging papers, the first-degree charge alleges Martinez inflicted sexual intrusion on a victim who was 10 years old at the time.
The man will be tried on one count of first degree sexual assault and one count of kidnapping-confinement. If convicted on all counts, he faces up to life in prison.
