A homeless man who says he was trying to stay warm overnight, has been arrested for the way he did it.

Nicholas Hisle has been arrested for Incineration Prohibited.

Casper Police say at around 6am on Thursday, June 2nd, a report came in regarding a trash can was on fire at Crossroads Park and there was someone sitting next to it.

When officers arrived on scene, they saw Hisle walking away, and he was carrying a tree branch that was blackened on one end due to starting a fire.

When questioned, Hisle said at first he started the fire and was watching the sun rise, then said he was homeless and stayed in the dug out of a softball field and needed to start a fire due to being cold.

He later added that he had been burning trash throughout the night.

Officers explained to Hisle that he can not start garbage can fires in a city park, and there are warm places for the homeless.

Hisle was then taken into custody.
